Democrats Sent Big Tech a Censorship Demand That a Federal Court Already Ruled They Can’t Make

Democrats used the FBI to bury the Hunter Biden laptop story just weeks before the 2020 election.

A federal court later confirmed that operation was illegal – and banned the government from ever doing it again.

This week, four Democrats sent 25 tech companies a letter that contains exactly what that judge banned.

How Democrats Used the FBI to Bury the Hunter Biden Laptop Before the 2020 Election

Before the 2020 election, the FBI held weekly meetings with Facebook, Twitter, and Microsoft – priming them for what the bureau called potential "hack-and-leak operations."

When the New York Post broke the Hunter Biden laptop story in October 2020, Big Tech companies were already conditioned to treat any Biden family story as Russian disinformation – and they buried it.

Mark Zuckerberg admitted to Joe Rogan that Facebook suppressed the story after the FBI warned it might be Russian disinformation.

FBI Supervisory Special Agent Elvis Chan confirmed under oath in the Missouri v. Biden civil lawsuit that agents held those same meetings with Big Tech companies to encourage censorship ahead of the election.

The FBI had authenticated the laptop in November 2019 – a full year before the bureau pressured social media to bury it anyway.

The Democrats Demanding Election Censorship and the First Amendment Case That Already Answered Them

Senate Intelligence Committee Democrat Mark Warner and three fellow party members sent a letter to 25 tech companies demanding they ramp up censorship before November 3rd.

The co-signers were California Senator Alex Padilla, Connecticut Congressman Jim Himes, and New York Congressman Joe Morelle – together, the four control the Senate and House committees that oversee both intelligence and elections.

The targets include Rumble, SpaceX, Meta, Microsoft, OpenAI, TikTok – and Truth Social, the platform Donald Trump built specifically to escape this kind of political pressure.

The letter orders companies to immediately remove anything labeled false election information, deploy independent fact checkers, and notify users when they have engaged with content later flagged as misleading.

AI chatbots, it adds, must pull answers only from sources Democrats themselves get to approve.

Nobody elected Mark Warner to decide what qualifies as authoritative.

In March 2026, a federal court signed a consent decree in Missouri v. Biden permanently barring the government from coercing social media companies over their content.

The decree confirmed the government "unlawfully pressured, coerced, induced, and encouraged major social media platforms to censor their posts" – about COVID, the Hunter Biden laptop, and the 2020 election.

Warner decided to ignore the Supreme Court and started drafting this new letter.

One sentence in it crosses the exact line the court drew.

The letter tells the 25 companies the FTC has a history of taking enforcement action against companies that fail to follow through on their commitments.

That is a senator with intelligence committee access telling 25 companies the federal government will come for them if they refuse to suppress what his party wants suppressed.

That is exactly what the consent decree prohibits.

Warner delivered that threat anyway – on congressional letterhead.

Why Warner's Pre-Midterm Letter to Big Tech Is Election Interference by Another Name

Warner knows he cannot send the FBI this time.

A federal judge already ruled that illegal and locked it in a ten-year court order.

So he sent a letter instead – four powerful senators, 25 companies, one FTC threat, and no FBI logo at the top.

The letter criticizes platforms for cutting "trust and safety" teams – code for any platform that followed Elon Musk's model of free speech instead of the censorship infrastructure Democrats built and a court later dismantled.

The Hunter Biden laptop story was real, it was suppressed before the 2020 election, and Biden won.

Warner wants that outcome again for conservative speech before November 3rd – the same silence, the same pressure, dressed in the new language of "election integrity."

The consent decree Warner's own party triggered is the only legal ground those companies have to ignore this letter.

They should use it.
