How the Dobbs Leak Put Conservative Supreme Court Justices in the Line of Fire

Mollie Hemingway's new book Alito: The Justice Who Reshaped the Supreme Court and Restored the Constitution – sourced from interviews with more than 100 former clerks and most of the justices themselves – lays out what happened inside the Supreme Court after the Dobbs draft leaked in May 2022.

Justice Alito had the majority opinion finished by early February 2022.

The other conservative justices signed on almost immediately.

Then the liberal justices sat on their dissent for months.

When the draft leaked to Politico on May 2, protesters immediately descended on the homes of the five conservative justices.

Pro-abortion groups posted their home addresses online.

Radicals firebombed more than 100 pro-life clinics and churches across the country.

The Alitos were moved to a secret location.

Barrett suited up in a bulletproof vest in front of her kids.

Everyone inside the court understood the math: a ruling is not final until it is read from the bench.

Kill one of the five conservative justices before that moment and Roe stays the law of the land.

Alito and Gorsuch went into conference and asked the liberal dissenters to hurry up – for everyone's safety.

Gorsuch pressed them for a specific date.

The liberals refused to give one.

Then Kagan went to Breyer's chambers.

Breyer – a gentleman who was genuinely concerned about what was happening to his colleagues – was the one liberal willing to consider helping.

Kagan screamed at him not to accommodate the majority, so loudly that observers said the wall was shaking.

A deranged Biden supporter was already buying his ticket to Dulles.

Nicholas Roske Came to Kill a Supreme Court Justice and the Liberal Justices Knew It

Nicholas Roske left California on June 7, 2022, with a Glock pistol, ammunition, zip ties, a tactical knife, a hammer, duct tape, and pepper spray.

He flew to Dulles, took a taxi to Kavanaugh's neighborhood in Maryland, and showed up at 1:05 in the morning wearing all black.

He told investigators he wanted to kill Kavanaugh to save Roe.

Federal prosecutors confirmed he had also researched three other justices and their home addresses – he was planning to kill multiple members of the court to change the outcome of Dobbs.

He pleaded guilty in April 2025 and received 97 months in prison – a sentence Attorney General Pam Bondi called "woefully insufficient" and immediately appealed.

Fifty-three days passed between the Dobbs leak and the final ruling, and every one of them was a day someone could have killed Kavanaugh, Alito, Thomas, Gorsuch, or Barrett and reversed the decision.

Kagan screamed at the one person willing to shorten that window to make sure he did not.

Former clerks – multiple, speaking anonymously – described her to Hemingway as emotionally abusive, demanding, demoralizing, and demeaning, with moods that swung from warm to vicious without warning.

Clerks who worked for other justices said Kagan's clerks had fear in their eyes.

Alito's clerks called him possibly the smartest person they had ever met – someone so meticulous he apologized when he rewrote their work.

Thomas is described as one of the most beloved figures at the entire court.

The people who lecture America about compassion run their own offices on fear.

The Dobbs delay was not a principled legal stand.

It was Kagan – a woman who terrorizes her own staff – using that same cruelty to keep conservative justices in a kill zone as long as possible.

Then Attorney General Merrick Garland refused to prosecute the protesters camping outside the justices' homes or enforce the federal law prohibiting demonstrations designed to intimidate judges.

Biden's press secretary called the protests peaceful.

FBI Director Kash Patel has since announced they are reopening the investigation into who leaked the Dobbs draft.

If they find the leaker – and they should – the chain from that leak to Kagan's screaming fit to Roske's taxi ride becomes impossible to ignore.

This is not ancient history.

In February 2026, Clarence Thomas canceled an in-person appearance at a legal conference at American University and joined remotely from Senator Mike Lee's Capitol Hill office after a security risk forced him to change plans.

He told the room: "I wanted to make sure I didn't endanger anyone by my mere presence."

The longest-serving justice on the Supreme Court cannot walk into a law school without calculating whether his presence will get someone killed.

Four years later, Clarence Thomas is still paying for what Elena Kagan did in that hallway.
