Democrats spent years calling noncitizen voter fraud a right-wing conspiracy theory.
Now a Democrat governor just confessed it happened in her own state.
What the Justice Department did next is something she cannot talk her way out of.
New Jersey Voter Rolls and the Software Story That Fell Apart
New Jersey Gov. Mikie Sherrill stood at a podium and announced that 6,600 noncitizens were registered to vote in the Garden State – then called it a glitch.
The software vendor told a different story.
IDEMIA, the France-based company that ran the Motor Vehicle Commission's registration system, told the New York Post that New Jersey officials had access to the exact same citizenship data – and registered the noncitizens to vote anyway.
"All 6,600 individuals indicated 'Yes' to wanting to register to vote and 'NO' to being a US Citizen," IDEMIA spokeswoman Lisa Shoemaker told the Post. "This information was recorded correctly and always available."
The system did not malfunction. The system flagged 6,600 people as ineligible. New Jersey's Division of Elections saw those flags and processed the registrations.
Sherrill blamed the French company. The French company pointed at Trenton.
DOJ Gives New Jersey Five Days to Hand Over Voter Registration Records
Assistant Attorney General Harmeet Dhillon had already sent New Jersey a letter on July 7 demanding access to the state's voter rolls. Sherrill's press conference gave her something more to work with.
"Ensuring that U.S. citizens' votes are not illegally diluted by noncitizens' votes is of paramount importance," Dhillon wrote in a letter to Sherrill and Lt. Gov. Dale Caldwell.
Dhillon wants the full names, dates of birth, nationalities, residential addresses, and registration dates of all 6,600 noncitizens – and the full voting records of the roughly 400 who cast ballots, including mail-in certifications and signatures.
She also ordered the state to preserve every document connected to the disclosure.
Five business days. Not a request. A demand backed by federal statute and an active federal lawsuit.
The DOJ is already in litigation – United States v. Caldwell – seeking New Jersey's unredacted voter file. Dhillon notified the presiding judge of the developments the same day. New Jersey just handed the Trump administration a very large piece of ammunition.
400 Noncitizen Votes and the Election Margins That Make Them Matter
Sherrill insisted at her press conference that there is "no evidence at this time that any elections were swayed" by the 400 illegal votes.
That is not the standard.
New Jersey Assembly Republican Leader John DiMaio said it in a press release: "Trenton Democrats have continued to undermine public trust in our elections, and it's time for change."
The math answers Sherrill for him. Al Franken beat Norm Coleman for a U.S. Senate seat by 312 votes. Harry Reid survived John Ensign by 428. Christine Gregoire won a Washington governor's race by 133.
Elections get decided by margins smaller than 400 votes with real regularity. A state's total voter count is irrelevant. What matters is whether one illegal vote canceled one legal vote in one race. Four hundred times over.
DHS has flagged more than 35,000 potential noncitizens on New Jersey's voter rolls overall.
DOJ analysis across four states – New Jersey, California, Nevada, and Pennsylvania – found more than 250,000 potential noncitizens registered to vote. California alone accounted for nearly 191,000 of them.
Democrats Called Noncitizen Voter Fraud a Conspiracy Theory and Got Caught
This story landed after Trump delivered a speech on election security that Democrats dismissed outright.
Sherrill's spokesman accused the Trump administration of having a "long history of weaponizing" the DOJ to "overturn election results."
The New Jersey Governor stood at the press conference and accused Trump of making "bizarre conspiracy theories about fraud with no evidence" – while simultaneously announcing that 6,600 noncitizens had been registered to vote and 400 of them had cast ballots.
Democrats have labeled the SAVE America Act – legislation requiring proof of citizenship to vote – "Jim Crow 2.0." They argued that any effort to verify voter citizenship would disenfranchise legitimate voters.
But it was the absence of verification in New Jersey that canceled out the votes of 400 legal American citizens – a point Dhillon drove home in her letter to Sherrill.
Jake Tapper acknowledged on air that the disclosure is "not good for Democrats' argument that there's no such thing as undocumented immigrants voting."
That is not a small concession from CNN's flagship anchor.
New Jersey had a choice. Verify citizenship before registering voters – or don't. Trenton chose don't, for years, even after Republican warnings. Harmeet Dhillon just gave Trenton five business days to prove that claim under oath.
