Robert Mueller died with his FBI files sealed from his witch hunt into the Russian collusion hoax.
Now Judicial Watch is suing the DOJ to open them.
What those records contain is something Mueller's defenders have spent years burying.
Mueller Built the FBI Surveillance Machine That Launched Russiagate
Robert Mueller ran the FBI from September 2001 through September 2013 – twelve years during which the bureau transformed itself into a domestic surveillance colossus.
Under Mueller's watch, the FBI weaponized the USA PATRIOT Act to issue what are called National Security Letters – secret demands that compelled banks, phone companies, and internet providers to hand over private financial and communications records without a judge's signature.
Recipients were legally forbidden from telling anyone the demand had arrived.
Mueller built that system.
Three years after he left the building, the FBI he built – steeped in the same surveillance culture, the same appetite for operating outside normal legal channels – launched Crossfire Hurricane.
That was the code name for the operation targeting Donald Trump's 2016 campaign, built on the bogus Steele dossier, a piece of opposition research paid for by Hillary Clinton's campaign and dressed up as intelligence.
The FBI used that fabricated document to obtain FISA warrants on Trump campaign adviser Carter Page.
An FBI lawyer named Kevin Clinesmith pleaded guilty to altering an email to make those warrants look legal.
Special Counsel John Durham later confirmed it: the bureau "lacked sufficiently corroborated information to justify opening a full investigation."
Mueller's investigation found no collusion.
Durham found no justification for starting the investigation in the first place.
DOJ Ignored the Judicial Watch FOIA Lawsuit for Four Months
Judicial Watch filed its FOIA request on March 24, 2026 – four days after Mueller died – seeking all records related to his tenure at the FBI and his work as special counsel.
The Justice Department's Office of Information Policy never responded.
That silence forced Judicial Watch into federal court in Washington.
The lawsuit connects directly to a broader accountability effort that already forced open the FBI's burn bag room – a facility at bureau headquarters that Kash Patel's team found crammed with more than 2 million pages of records after taking over the bureau.
The FBI told a federal judge last week that processing those records would take 158 years at its current pace.
That is not incompetence.
That is a strategy.
DOJ Silence on Mueller Is a Direct Defiance of Trump Declassification Order
"The American people deserve a full accounting of Robert Mueller's record – from the FBI's dramatic expansion of surveillance powers after September 11 to the abusive special counsel investigation targeting President Trump," Judicial Watch President Tom Fitton said.
"The Justice Department should immediately release every record concerning Mueller so Americans can judge his work for themselves."
Mueller is dead.
The political protection that came with his reputation – the bronze star, the bipartisan deference, the years of media mythologizing – died with him.
What remains are the documents.
President Trump issued a declassification memo in March 2025 ordering the immediate release of all materials related to Crossfire Hurricane.
The DOJ's refusal to even respond to Judicial Watch's request is a direct challenge to that order.
Senate Judiciary Committee Chairman Chuck Grassley separately forced out the formerly classified Durham annex in July 2025 – a document that confirmed Hillary Clinton's campaign ran a deliberate operation to falsely tie Trump to Russia.
The FBI knew.
Mueller's team operated in that environment.
Now Judicial Watch wants to know exactly what Mueller knew about the Clinton operation targeting Trump – and whether his team buried it.
That is what the files will show.
Steele Dossier FBI Burn Bag Room and Mueller Files All Point the Same Direction
The Left wants Mueller's legacy preserved – the decorated public servant, the impartial prosecutor, the man above politics.
The documents tell a different story.
The same FBI that Mueller spent twelve years building spent the next several years trying to remove a sitting president through manufactured evidence and secret surveillance courts.
Kash Patel's FBI is still pulling records out of safes, boxes, and burn bags at a facility that was deliberately hidden from incoming leadership – 2 million pages the Biden FBI never wanted anyone to find.
Judicial Watch has been fighting these battles in federal court for years – forcing out the Crossfire Hurricane launch memo, exposing Comey's communications, uncovering the Clinton email cover-up.
Every major revelation about the Russia hoax has had Fitton's fingerprints on it.
