Jonathan Turley Revealed the Mistake Ilhan Omar’s Staff Made That Could Get Her Deported

Federal agents swarmed Ilhan Omar's Washington home at 6 AM in a criminal immigration fraud investigation.

Law professor Jonathan Turley just explained why that investigation could strip her of citizenship entirely.

The specific detail buried in the official records is one her lawyers cannot explain away.

The Ilhan Omar Immigration Fraud Case Comes Down to One Year

Under federal law, Ilhan Omar became a U.S. citizen through what's called derivative citizenship – she piggybacked on her father's naturalization rather than applying on her own.

For derivative citizenship to be legal, her father had to have completed his own naturalization and she still had to be a minor when he did.

George Washington Law Professor Johnathan Turley told Fox News: "By saying that she was 17, she did not have to file for her own citizenship."

If she was actually 18 or older when her father naturalized, derivative citizenship was legally unavailable to her.

A report in the New York Post says congressional staff pushed to have Omar's official birthdate changed from 1981 to 1982 – changes that showed up on official records only after she had already won her congressional seat in 2018.

Former political rival A.J. Kern laid out the math: "For derivative citizenship, two things have to be true – one, her father had to naturalize; and two, she still had to be a minor – and what I have found is that it's highly likely that neither of those things are true."

When Kern submitted a FOIA request for her father's naturalization records, the National Records Center searched every variation of his name and came back empty.

The complaint he filed demanding proof of her citizenship was dismissed.

Until Monday.

Why Ilhan Omar Cannot Claim She Was Innocent of Immigration Fraud

Omar's team is calling the raid politically motivated – the same defense she's deployed against every fraud allegation for years – and Turley just explained why it collapses under immigration law.

"The immigration laws are very clear," Turley said. "When you're accused of illegally procuring citizenship or naturalization, it is not a defense that, 'I was innocent in all of this.'"

If the paperwork was false – even if a child had no control over what her father wrote – and that false paperwork is what secured citizenship she otherwise wouldn't have received, the citizenship can be revoked.

Turley confirmed on video: "This investigation began under the Biden administration."

Democrats cannot call it a political witch hunt when their own DOJ launched it.

Biden Started the Investigation That Could Get Ilhan Omar Deported

Vice President JD Vance told a podcast audience in March that Omar "definitely committed immigration fraud against the United States of America."

The Trump administration didn't build the denaturalization process specifically for Omar – it was already running.

In June 2025, the Department of Justice issued a formal memo directing civil division attorneys to "prioritize and maximally pursue denaturalization proceedings in all cases permitted by law and supported by the evidence."

The memo listed ten priority categories, including individuals who obtained citizenship through material misrepresentations – and Omar's case touches several of them.

Homeland Security Investigations is not the agency you send for routine immigration enforcement – it's DHS's criminal investigations unit, the same arm that dismantles human trafficking networks and organized crime operations, and their presence at Omar's home means someone signed off on a federal criminal warrant.

Homeland Security Secretary Markwayne Mullin had already warned last month that DHS was running an "ongoing investigation" into whether Omar lied on her immigration forms – and that "something's going to happen."

Something happened.

A conviction for naturalization fraud triggers automatic citizenship revocation and deportation proceedings.

An American congresswoman – someone who built a career campaigning on open borders and attacking ICE – facing deportation under the same immigration laws she tried to gut.

Changing an official birthdate from a congressional office in Washington isn't a childhood paperwork error – it's a deliberate choice made by people who knew exactly what they were protecting.

Federal agents now have a warrant, a DOJ investigation that predates Trump, and a legal standard that does not accept "I didn't know" as a defense.

Turley said the immigration laws are very clear.

They are.
