Biden's January 2025 pardon covered every federal offense Fauci may have committed from January 2014 through January 20, 2025 – the day Biden left office.
That protection ended the moment the clock hit midnight on Inauguration Day.
Solomon spelled out both paths Fauci faces when Senator Rand Paul puts him under oath before the Senate Homeland Security and Governmental Affairs Committee this month.
If Fauci tells the truth, he publicly admits he funded the Wuhan research, helped suppress the lab-leak findings, and lied to Congress for years.
Lie under that same oath again – and "he could be instantly prosecuted by the Trump Justice Department."
Biden's pardon is worthless against that.
Solomon said that no matter what both roads lead off a cliff.
Biden's team missed one critical legal mechanic.
Under Supreme Court precedent dating to 1896, a pardon eliminates criminal jeopardy – and with it, the Fifth Amendment protection against self-incrimination.
Fauci can no longer plead the Fifth.
Biden pardoned Fauci's past and handed Rand Paul a clean shot at his future.
The documents former DNI Tulsi Gabbard released also contradict Fauci's 2024 congressional testimony, when he told lawmakers he had no knowledge of any conversations with intelligence officials about the virus's origins.
The Evidence Paul Carries Into That Room
Tulsi Gabbard made sure Paul would not walk into that hearing empty-handed.
On June 18, in one of her final acts as Director of National Intelligence, she released a tranche of declassified documents accusing Fauci of funneling millions of American tax dollars into gain-of-function bat coronavirus research at the Wuhan Institute of Virology – the lab now widely believed to be the source of COVID-19.
The same research Fauci swore under oath he never funded.
According to the ODNI press release, Fauci directed "millions in US taxpayer dollars to fund dangerous gain-of-function research" on bat coronaviruses – then worked with politicized intelligence officials to push the natural-origin narrative that kept him shielded from accountability for years.
An intelligence community whistleblower had already testified before Paul's committee that Fauci actively helped cover up evidence pointing to Wuhan.
Analysts who pushed the lab-leak conclusion were told their careers ran through leadership.
Dissent was not tolerated.
Paul subpoenaed Fauci on June 23 after Fauci agreed to testify voluntarily – then walked away.
"He's been slow-walking information to us for six months or more," Paul told reporters.
Fauci is weighing a court challenge to the subpoena.
Paul believes he will lose – and pointed to federal courts' consistent record of enforcing congressional subpoenas against unwilling witnesses.
The Reckoning Five Years in the Making
Biden thought he was handing Fauci an exit.
What he handed Rand Paul was a key.
Solomon laid it out: Fauci walks into that hearing room this month stripped of his constitutional shield, surrounded by declassified files, whistleblower testimony, and six years of his own contradictions.
He can tell the truth and confess to Congress.
Lie again – and he faces the Trump Justice Department.
