One high school junior wanted to honor his legacy with a simple tribute.
But school officials called police on her, interrogated her without her parents present, and branded her a criminal for this shocking reason.
School district paints over Charlie Kirk tribute then calls police
Gabby Stout wanted to honor Charlie Kirk after his assassination shocked the nation.
The junior at Ardrey Kell High School in Charlotte, North Carolina called the school's front office on September 12 to ask permission to paint a tribute on the school's "spirit rock" — a large boulder that students use to display messages.
School officials told Stout she could paint the rock as long as the message didn't contain vulgarity or political speech.
Stout and two friends painted a heart and an American flag with the messages "Freedom 1776" and "Live Like Kirk — John 11:25," referencing the Bible verse about eternal life.
Within hours, school officials painted over the tribute.
Principal Susan Nichols sent a message to families on September 14 claiming the rock had been painted with an "unauthorized" message.
"Acts like these are considered vandalism to school property and are in violation of the CMS Code of Student Conduct,"¹ Nichols wrote. "If students were responsible for the vandalism, they may be disciplined. Law enforcement has been contacted and we are cooperating with the investigation."²
Stout was stunned at the accusation.
"I was completely shocked,"³ she told Fox News Digital. "I was very intimidated and scared, as I had no idea what I did wrong or that I could be getting in trouble for simply sharing and expressing my views and beliefs."⁴
District interrogates student then walks back vandalism claims
School officials pulled Stout out of class and forced her to write a statement without informing her of her rights or notifying her parents.
They also demanded her cell phone records.
Nearly a month later on October 11, Charlotte-Mecklenburg Schools sent an internal message to the Ardrey Kell community walking back the vandalism claims.
The message stated the rock painting was "not an act of vandalism,"⁵ "was not a violation of the student code of conduct,"⁶ and "law enforcement was not contacted to conduct an investigation."⁷
The school quietly closed the investigation with no apology and refused multiple requests from Stout's parents to publicly clear their daughter's name.
She received hateful messages including "Die like Kirk."⁸
They lied about calling police and treated a Christian teenager like a criminal for honoring a conservative martyr.
Stout developed health issues from the stress and ostracization.
Lawsuit exposes how school celebrates BLM but crushes Christian speech
On December 9, Stout's parents filed a federal lawsuit against the Charlotte-Mecklenburg Board of Education with help from Alliance Defending Freedom.
The lawsuit lays it out: school officials crushed Stout's religious and political speech while celebrating left-wing messages.
The double standard couldn't be more obvious.
In 2020, students painted the rock with "Black Lives Matter" messaging, including the closed fist symbol and names of people killed by law enforcement.
School officials permitted it.
When other students painted over the BLM message, the school board held an emergency meeting to restore it.
The rock was repainted with similar BLM messaging and the district took no action.
"So they'll facilitate that kind of left-wing student expression and not just facilitate it, but praise the students who participated,"⁹ ADF senior counsel Travis Barham said. "But let Gabby express a conservative or Christian view on the spirit rock, and criminal charges fly."¹⁰
After the Kirk tribute controversy, the school implemented new guidelines restricting the rock to only "school-related initiatives" and explicitly banning "personal, political, or religious messages."¹¹
The message was clear — liberal political speech gets praised and protected.
Conservative Christian speech gets painted over and the student gets threatened with criminal charges.
Stout refused to back down.
"I'm taking a stand because I want to glorify God, and I don't want other students to be punished for expressing their faith,"¹² she said. "Every student should feel safe sharing his or her beliefs without being shamed by school officials."¹³
The lawsuit seeks to hold Charlotte-Mecklenburg Schools accountable for unconstitutionally censoring protected speech and retaliating against a student for exercising her First Amendment rights.
School districts across the country need to learn they can't silence conservative Christian students while celebrating left-wing activism.
