The Clintons thought they buried this scandal for good.
But their past just caught up with them in federal court.
And Hillary Clinton was worried sick after a judge gave her this awful news.
Two Whistleblowers Spent Eight Years Fighting for This Day
A federal judge just consolidated two whistleblower cases against the Clinton Foundation, clearing the path for a trial that could expose one of the biggest political cover-ups in modern history.
Retired federal agent John Moynihan and fraud investigator Larry Doyle have been battling the IRS in U.S. Tax Court since 2017 when they filed complaints alleging the Clinton Foundation violated federal tax law by operating as an unregistered foreign agent while Hillary Clinton ran the State Department.
Chief Judge Patrick J. Urda ordered the cases consolidated and demanded both parties submit status reports by January 9, 2026.
The whistleblowers assembled more than 6,000 pages of evidence showing the foundation accepted hundreds of millions in foreign donations while Hillary granted donors access to the State Department.
They submitted their findings to the IRS under the whistleblower program, which rewards citizens who expose tax fraud.
But instead of investigating, the IRS buried the case.
That's when the whistleblowers took the agency to court, demanding the award they were legally owed for exposing what one FBI agent called evidence that "the entire enterprise is a fraud."¹
Obama's Deputy Attorney General Ordered FBI to "Shut It Down"
Here's the part that should terrify every American who believes in equal justice under the law.
Documents obtained by FBI Director Kash Patel show that Obama Deputy Attorney General Sally Yates explicitly ordered FBI agents investigating the Clinton Foundation in 2016 to "shut it down."²
Not investigate it differently. Not handle it more carefully. Shut it down.
The FBI had three separate field offices — New York, Washington D.C., and Little Rock — running investigations into possible pay-to-play corruption during the 2016 election.
Then Yates stepped in and killed all three probes.
A timeline written by a DOJ lawyer assigned to the FBI shows that FBI Deputy Director Andrew McCabe ordered agents to take "no overt investigative steps" without his personal approval starting in February 2016.³
By March 2016, Yates had issued the final order to shut everything down.
The same Justice Department that was ramping up the completely false Russia collusion investigation against Trump was simultaneously protecting the Clintons from legitimate criminal probes backed by mountains of evidence.
The Pattern Special Counsel Durham Exposed
John Durham's 306-page report on the Russia investigation revealed that the FBI had at least four ongoing investigations into Clinton business dealings during the 2016 election.⁴
Durham found that one probe involved a foreign government planning to send someone to make large contributions to Clinton's campaign "as a way to gain influence with Clinton should she win the presidency."⁶
An FBI source reported that Clinton campaign workers "were okay with it" and "were fully aware from the start."⁷
But FBI agents working the cases told Durham they were "tippy-toeing" around Clinton "because there was a chance she would be the next President."⁸
That fear-based approach stands in stark contrast to how those same FBI leaders treated Trump.
Durham wrote that "the immediate opening of Crossfire Hurricane as a full investigation contrasts with the care taken in connection with the investigation of the Clinton Foundation."¹⁰
Special Counsel Durham discovered the FBI ignored intelligence from the CIA showing Hillary Clinton personally approved a plan to manufacture the Trump-Russia narrative to distract from her email scandal.
FBI agents never investigated whether Clinton's campaign created the collusion hoax, but they used the fake Steele Dossier — paid for by Clinton's campaign — to obtain surveillance warrants on Trump campaign aide Carter Page.
Whistleblowers Won't Stop Fighting Despite IRS Resistance
The Trump administration's IRS tried blocking this trial by filing a motion to dismiss the case in August 2025, arguing the whistleblowers don't have standing because the IRS initially declined to investigate their complaint.
Tax Court Judge David Gustafson already rejected that exact argument once before in October 2020.
Gustafson cited non-public evidence that the FBI and IRS "may have worked jointly on a criminal investigation focused on the Clinton Foundation."¹¹
Now Chief Judge Urda's consolidation order shows the case advancing toward trial despite continued IRS resistance.
Larry Doyle told Just the News the IRS motion was predictable: "Not surprising that the IRS would seek to dismiss our case in this fashion simply because that is the same tactic the IRS deployed in our initial case ongoing now almost 6 years in US Tax Court and growing more serious everyday."¹²
"The simple fact is the more the American public learns about the Clinton Foundation as it has in recent days, the more it is entitled to know all the truth and facts involved," Doyle added.
The whistleblowers testified before Congress in December 2018 that the Clinton Foundation "began acting as an agent of foreign governments early in its life and throughout its existence."¹³
Moynihan stated under oath that "the foundation should've registered under FARA" — the Foreign Agent Registration Act — and that "the foundation and its auditors conceded in formal submissions that it did operate as a foreign agent."¹⁴
If true, that means the Clinton Foundation wasn't entitled to its tax-exempt status and should have been paying taxes on hundreds of millions in foreign donations all along.
The consolidation of these cases sets the stage for all that evidence to finally see daylight in a courtroom, where the Clintons won't have Obama Justice Department officials running interference for them anymore.
