Democrats Are Spending $350 Million in Taxpayer Money on Free Lawyers for Illegal Immigrants
This is not about the right to a lawyer. Criminal defendants already get that.
Immigration proceedings are civil – the legal equivalent of an eviction. No 6th Amendment right applies. No court requires it.
Art Arthur, a former immigration judge and resident fellow at the Center for Immigration Studies, said: "You don't have a right to pay counsel in civil proceedings any more than you do in tenant-landlord court or divorce court."
Democrat cities don’t care. State and local jurisdictions ramped up taxpayer funding for illegal alien deportation defense from $250 million in 2024 to $350 million in 2025.
Four more states joined the program last year, bringing the national total to at least 14 state-level schemes.
Lucio Tomar's case shows exactly what that money buys. The Cape Verdean illegal alien racked up at least 17 arrests in Massachusetts for open and gross lewdness, three more for indecent exposure, and two for failing to register as a sex offender – all while living here since 2003.
An immigration judge ordered him deported in July 2024. The Board of Immigration Appeals upheld that order in November 2024. Then a panel of three Biden-appointed federal judges reversed it, deciding that Massachusetts lewdness convictions might not count as deportable offenses because – and this is real – nude sunbathers can get the same charge.
Massachusetts taxpayers bankrolled every stage of that argument. Maria Hwang of the Massachusetts Committee for Public Counsel Services – a state-funded legal agency – was listed as Tomar's attorney in court documents.
Larry Krasner Created a Taxpayer-Funded Office to Help Criminal Illegal Aliens Avoid Deportation
The defense attorney scheme is only half the problem.
On the prosecution side, Democrat district attorneys are now running interference for criminal illegal aliens from inside their own offices.
Philadelphia District Attorney Larry Krasner – backed by George Soros money – created a dedicated immigration counsel position in 2018 with a singular mission: help foreign nationals avoid convictions that trigger deportation.
Krasner promised the position would handle only low-level offenders. Records say otherwise. His immigration counsel advised on cases involving illegal aliens charged with murder, arson, rape, sexual assault, and rape of a child.
When FOIA requests came in for 2025 case records, Krasner's office suddenly claimed it couldn’t find what cases its own immigration attorney worked on – despite complying with identical requests in 2021 and 2024.
Manhattan DA Alvin Bragg and Fairfax County, Virginia DA Steve Descano have made similar declarations – immigration consequences factor into how they charge illegal alien defendants.
Matt O'Brien of the Federation for American Immigration Reform named exactly what this is: "Foreigners wind up treated more favorably by the courts than citizens of this country, because they are accorded privileges – based on their immigration status – that simply aren't available to Americans."
Democrat Cities Are Funding a Parallel Justice System While American Citizens Get No Free Lawyers
Cook County's public defender office represented illegal aliens in 109 federal immigration cases in 2025 – cases spread across jurisdictions throughout the country. The county just added up to seven new positions to its immigration unit for 2026 as part of a $10 billion budget.
New York State lawmakers handed over $175 million in illegal alien legal defense spending in March, pushing total illegal alien legal and social services spending to $183 million for fiscal year 2027.
Boston Mayor Michelle Wu announced additional millions the same month and cited "ongoing attacks" by the Trump administration as her justification. Wu is not hiding the ball – she is telling you directly that your money is a weapon aimed at federal law enforcement.
Democrat politicians are openly declaring that blocking Trump's deportation of criminal aliens is the reason they are writing checks from your tax account.
A 70-year-old widow fighting her landlord in civil court handles it herself or goes without. But a foreign national with 17 lewdness arrests gets a state-funded legal team, a two-year fight in federal court, and a Biden judge to hand him the win.
O'Brien put it directly: "It's mind boggling that prosecuting attorneys are now taking violations of immigration law into account as a mitigating factor. And to top it all off, immigration impact units are staffed by defense attorneys, but funded and run by prosecutor's offices – which is a profound conflict of interest."
The Trump administration is trying to remove dangerous criminals. Democrat cities are funding the legal army fighting them every step of the way – and they are charging you for it.
