Trump’s secret weapon against woke policies

Most conservatives have written off civil rights law as a lost cause – something inherently designed to favor leftist policies and DEI programs.

But Andrea Lucas, the acting chair of the Equal Employment Opportunity Commission, just pulled back the curtain on how Donald Trump is using the Left’s own legal weapons to destroy their woke agenda.

In an exclusive interview with the Washington Free Beacon, Lucas revealed the brilliant long-term strategy she’s been executing – and it’s been hiding in plain sight for years.¹

Lucas served as a dissenting EEOC commissioner throughout the entire Biden administration, but she wasn’t just playing defense.

She was setting up the most devastating counterattack against DEI that the woke establishment never saw coming.

"When the only people who use civil rights laws are leftists, the law will always trend left," Lucas explained. "Conservatives did not realize how conservative civil rights law was and let the left skew it in all sorts of ways."

The blueprint for turning civil rights law against the Left

Here’s where Lucas’s strategy gets absolutely brilliant.

While Democrats spent four years trying to weaponize federal agencies against conservatives, Lucas was quietly using her position to lay the legal groundwork for Trump’s return.

She filed what’s called a "commissioner’s charge" against Columbia University in spring 2024 – a rarely used but incredibly powerful tool that allows a single commissioner to launch investigations unilaterally.²

The result? A devastating $21 million settlement for Jewish employees who faced anti-Semitic discrimination at Columbia.

But that was just the beginning.

Lucas has already gotten major law firms to ditch their DEI programs, opened investigations into Harvard University, and is systematically dismantling the entire woke infrastructure piece by piece.

"We are going to make sure there are consequences if you break the law," Lucas said. "I hope people realize we’re really serious."

How conservatives can weaponize civil rights law

The genius of Lucas’s approach is that she’s not trying to eliminate civil rights law – she’s exposing how fundamentally conservative it actually is.

Title VII, the cornerstone of civil rights legislation, protects all races and both sexes equally.

It’s not like other laws that only protect specific groups – it’s designed to be completely colorblind.

"Title VII doesn’t say we’re only protecting ‘historically underrepresented minorities,’" Lucas explained. "It’s protecting everyone."

This means every time a company implements racial quotas or DEI hiring preferences, they’re actually violating the very law they claim to be following.

Lucas revealed that the EEOC has been leading on colorblind enforcement since the 1960s and 1970s, long before the woke takeover of corporate America.

The Supreme Court adopted this framework in McDonald v. Santa Fe Trail Transportation Company in the 1970s, establishing that civil rights law applies equally to white employees.³

So when companies announce their intent to discriminate based on race through DEI programs, they’re essentially providing written evidence of their own Title VII violations.

"You’ve got lots of corporations that went out of their way to announce their intent to everyone – to their investors, their employees, their managers," Lucas pointed out.

What has the woke establishment absolutely terrified is that Lucas is proving conservatives can use the exact same legal tools that Democrats have been wielding for decades.

For years, leftist activists have used "hostile work environment" claims to police speech and cancel conservatives.

But Lucas revealed that in 2020, "there were a lot of people who suffered hostile work environments, who were conservative, and who could have brought hostile work environment claims but didn’t."

Her message to conservatives is simple: "If you don’t use the tools that are there, the left is always going to use those tools."

The commissioner’s charge tool that Lucas used against Columbia? Democrat appointees have wielded this weapon repeatedly over the years while Republican commissioners largely ignored it.

"It’s a rarely used tool, but a really powerful one," Lucas noted. "And I think some prior iterations of Republicans in this agency have not been willing to use that power, even though it’s very clearly in our statute."

Why this changes everything

Lucas’s strategy exposes the fatal flaw in the conservative argument that civil rights law is inherently leftist.

The real problem wasn’t the law itself – it was that conservatives abandoned the battlefield entirely.

"Conservatives ceded the field to liberals," Lucas explained. "They thought that civil rights was always synonymous with woke, or they were interested in doing other things like building companies and industry."

But while conservatives were building businesses, leftists were building legal arsenals.

Now Lucas is showing how to turn those weapons around.

She’s not just going after obvious DEI violations either – she’s targeting the sophisticated workarounds that companies have been using.

When asked about firms that "strongly encourage" certain racial groups to apply while not extending the same encouragement to others, Lucas made clear this could violate Title VII.

"It certainly could be evidence," she stated. "It certainly implies a preference, at best, if not something even more overt."

Lucas’s approach represents a fundamental shift in how conservatives engage with civil rights enforcement.

Instead of complaining about the system, she’s showing how to dominate it.

Her agency has been deliberately quiet about most of their investigations due to confidentiality requirements, but the public victories keep mounting.

The Columbia settlement alone covers "literally every Columbia employee affected by anti-Semitism" and sends a clear message to other institutions.⁴

Lucas also revealed that much of the extreme gender ideology pushed during the Biden years came directly from political appointees, not some mythical "deep state."

"It was not a bottom-up thing coming from the EEOC," she explained. "It was very much top-down."

This means the battle for these agencies comes down to who’s making the appointments – and conservatives finally have someone who knows how to fight.

The woke establishment spent years believing they had a monopoly on civil rights enforcement.

Andrea Lucas just proved them catastrophically wrong.

And the legal war against DEI is just getting started.
