Federal judge strikes down decades-old law favoring illegal aliens

For over 20 years, Texas has been quietly allowing illegal aliens to pay dramatically lower tuition rates at public universities than out-of-state American citizens.

This ridiculous policy finally came to an end when a federal judge permanently blocked the state from enforcing the discriminatory law.

District Judge Reed O’Connor ruled that the challenged provisions "violate the Supremacy Clause and are unconstitutional and invalid" as applied to aliens who are not lawfully present in the United States.

Texas Attorney General Ken Paxton joined forces with the Trump administration’s Justice Department, arguing that the statute "expressly and directly conflicts" with federal immigration law.

"The Court also hereby permanently enjoins Defendant as well as its successors, agents, and employees, from enforcing Texas Education Code § 54.051(m) and § 54.052(a), as applied to aliens who are not lawfully present in the United States," O’Connor ruled.

Republican Governor Greg Abbott wasted no time celebrating the decision on social media.

"In-state tuition for illegal immigrants in Texas has ended," Abbott declared on X.

The shocking scope of this taxpayer-funded giveaway

The numbers behind this discriminatory policy are absolutely staggering.

At the University of Texas at Austin, the financial disparity is shocking. Out-of-state students face annual tuition bills between $40,582 and $48,712, while in-state students pay just $10,858 to $13,576.

That means illegal aliens were getting a discount of up to $35,000 per year compared to American citizens from other states who wanted to attend Texas universities.

The 2001 law was passed during the administration of former Republican Governor Rick Perry, who later served as energy secretary during President Trump’s first term, and allowed illegal aliens students who lived in Texas for at least three years leading up to their high school graduation to qualify for the massive discount.

All they had to do was pledge to apply for permanent legal status – a requirement with limited enforcement mechanisms.

Texas was actually the first state in the nation to pass such legislation, which spread to dozens of other states over the years.

The law survived multiple Republican-led efforts to repeal it in the Texas Legislature, showing just how deeply the swamp runs even in red states.

Trump administration takes decisive action

The Trump administration didn’t waste any time challenging this unfair system that puts American citizens at a disadvantage.

In their federal lawsuit, the Justice Department made their position clear: "federal law prohibits illegal aliens from getting in-state tuition benefits that are denied to out-of-state U.S. citizens."

The lawsuit emphasized: "There are no exceptions. Yet the State of Texas has ignored this law for years. This Court should put that to an end."

Attorney General Pam Bondi made it crystal clear what was at stake in this case.

"Under federal law, schools cannot provide benefits to illegal aliens that they do not provide to US citizens," Bondi said in a statement. "The Justice Department will relentlessly fight to vindicate federal law and ensure that U.S. citizens are not treated like second-class citizens anywhere in the country."

The legal challenge was based on Trump’s executive orders, including "Ending Taxpayer Subsidization of Open Borders" and "Protecting American Communities From Criminal Aliens."

A major victory for fairness and the rule of law

Texas Attorney General Ken Paxton called the ruling a massive win for common sense and constitutional principles.

"Ending this discriminatory and un-American provision is a major victory for Texas," Paxton said in a statement.

This decision exposes the absurdity of policies that favor people who broke our immigration laws over American citizens who followed the rules.

For two decades, Texas families watching their kids get rejected from state universities knew that illegal aliens might be taking spots that should have gone to their children – all while paying a fraction of the cost.

The ruling also highlights how deeply the open borders mentality had infected even supposedly conservative states like Texas.

It took Donald Trump’s return to the White House and his America First agenda to finally put an end to this outrageous discrimination against American citizens.

This victory in Texas could be just the beginning of a nationwide effort to roll back similar laws in dozens of other states that put illegal immigrants ahead of American students.

The days of treating American citizens like second-class citizens in their own country are finally coming to an end.
