Trump-appointed Justice sides with liberals against deportation efforts
The Supreme Court handed President Donald Trump a significant win on Monday with a 5-4 ruling that allows his administration to invoke the 1798 Alien Enemies Act to deport Venezuelan nationals from the United States.
This historic ruling cleared the way for Trump’s border czar Tom Homan to continue the largest deportation operation in American history. The law gives the President sweeping authority to remove “dangerous” immigrants during times of national emergency or conflict.
What stunned conservatives across the country was that Trump-appointed Justice Amy Coney Barrett broke ranks with her fellow conservative justices and joined the three liberal justices in dissent.
Senator Mike Lee (R-UT), a staunch Trump ally, expressed his dismay on social media platform X.
“This is disappointing,” Lee wrote, reflecting the sentiment of many conservative voices who expected Barrett to side with the other Trump appointees.
Elon Musk delivers scathing response to Barrett’s decision
Tech billionaire Elon Musk, who heads President Trump’s Department of Government Efficiency (DOGE), didn’t mince words about Barrett’s decision to join the liberal Justices.
“Suicidal empathy is a civilizational risk,” Musk posted on X, suggesting Barrett’s sympathy for illegal aliens posed a danger to American society.

Conservative influencer Rogan O’Handley, known as DC Draino on X, highlighted the shocking nature of Barrett’s vote.
“While this Supreme Court victory for Trump allowing him to deport cartels is huge, it was only a 5-4 decision. Guess who joined the 3 liberal Justices to keep cartels here in America? Amy Coney Barrett,” O’Handley wrote.

The ruling came after President Trump successfully deported at least 261 migrants last month, including more than 100 Venezuelans specifically under the 1798 law.
White House celebrates victory despite Barrett’s betrayal
White House Press Secretary Karoline Leavitt was asked about Barrett’s surprise vote during Tuesday’s press briefing by LindellTV reporter Cara Castronuova.
While not directly addressing Barrett’s defection, Leavitt emphasized the administration’s satisfaction with the overall result.
“We believe this was a massive victory,” Leavitt stated. “Certainly, we wish this was a 9-0 decision because we firmly believe the president was well within his constitutional authority and the Supreme Court made that very clear last night.”
The 5-4 ruling allows the Trump administration to continue its aggressive approach to border security, which has become a cornerstone of Trump’s second term in office.
Not the first time Barrett has disappointed conservatives
This isn’t the first time Justice Barrett has broken with her conservative colleagues since joining the Supreme Court.
In a notable 2024 case, Barrett issued a sharp dissent against a 6-3 ruling that said the Justice Department had overstepped its authority in charging January 6 protesters at the U.S. Capitol with obstruction.
That decision likewise left many Trump supporters questioning Barrett’s commitment to the conservative legal principles she was expected to uphold when Trump nominated her to replace the late Justice Ruth Bader Ginsburg.
The Alien Enemies Act, which dates back to the founding of the republic in 1798, gives the President broad powers to protect the nation from foreign threats. The Biden administration and activist Judges had attempted to block Trump from using this legal authority.
But the Supreme Court’s ruling confirms that President Trump has the constitutional authority to take decisive action to secure America’s borders and protect its citizens from dangerous criminal aliens.
Despite Barrett’s unexpected vote, President Trump can now move forward with his promise to conduct the largest deportation operation in American history, targeting gang members, drug dealers, and other criminal aliens who pose a threat to public safety.
