Federal Judge finds “probable cause” to hold Trump administration in criminal contempt

A Federal Judge ruled on Tuesday that there is “probable cause” to hold Trump administration officials in criminal contempt for violating court orders to halt deportations.

U.S. District Judge James Boasberg, an Obama appointee, issued a 46-page ruling accusing the administration of “willful disregard” of his order to stop deportations to El Salvador.

The case involves Kilmar Abrego Garcia, who was deported to El Salvador despite a Judge’s order to stop the removal.

Boasberg didn’t mince words in his blistering assessment, writing that the government’s actions on that day “demonstrate a willful disregard for its order, sufficient for the court to conclude that probable cause exists to find the government in criminal contempt.”

The Judge expressed that he was “offended” that people inside the DOJ seemed to be “joking” about the serious nature of the court orders.

This ruling represents a significant escalation in the ongoing battle between the judiciary and the Trump administration’s aggressive immigration enforcement policies.

Since taking office in January, President Trump has made mass deportations a cornerstone of his second administration, promising to remove millions of illegal aliens from the country.

The White House has repeatedly clashed with Federal Judges who have attempted to slow or halt these deportations through judicial orders.

In this particular case, planes carrying deportees to El Salvador had already departed when Judge Boasberg issued his order to halt the removals.

The administration argues that Federal Judges lack jurisdiction over deportation flights once they’ve entered international airspace.

But Judge Boasberg firmly rejected this argument, making it clear that he believes the administration deliberately ignored his ruling.

The case has become a flashpoint in the larger debate over executive power versus judicial authority in immigration matters.

Trump has consistently argued that border security and immigration enforcement fall squarely within the President’s constitutional authority.

His administration has moved aggressively to find legal workarounds to judicial roadblocks, much as they did recently when ordered to restore the Associated Press to the White House press pool.

In that instance, rather than simply complying with the injunction, the White House eliminated the position entirely.

Critics see these maneuvers as dangerous end-runs around judicial authority, while supporters view them as legitimate exercises of executive power.

CNN Senior Reporter Edward-Isaac Dovere observed, “Look, we are not even a hundred days into this administration, but it has been clear from pretty much the beginning that… we were in a situation where the White House and the courts are on a collision course.”

The most alarming aspect of Judge Boasberg’s ruling is the specific designation of “criminal contempt,” which carries potentially serious consequences for administration officials.

The Judge wrote that “the court does not reach such a conclusion lightly or hastily,” emphasizing the gravity of the situation.

For his part, President Trump has previously stated that he would follow court orders, but his administration has consistently sought to exploit legal loopholes to advance his immigration agenda.

This ruling sets up a potential constitutional showdown reminiscent of President Andrew Jackson’s famous defiance of the Supreme Court, when he allegedly said, “The Judge has made his ruling now, let him enforce it.”

The question now becomes whether the Trump administration will find another creative legal workaround or whether they will directly challenge judicial authority in a way no modern President has dared.

White House officials have yet to respond to the ruling, likely waiting for guidance from the Department of Justice on next steps.

Meanwhile, immigration advocates are celebrating the ruling as a rare check on what they view as the administration’s overreaching deportation machine.
