And an activist judge just issued one ridiculous ruling to block Trump.
Leftist judge blocks federal audit
Democrats are panicking like never before.
Donald Trump turned off the money spigot for their left-wing patronage system, and they don’t know what to do.
Trump created the Department of Government Efficiency (DOGE) and tapped Elon Musk to run it.
Musk and his team have been uncovering scads of waste, fraud, and abuse, and the Democrats are desperate to stop his veritable audit.
That’s why Barack Obama appointee Judge Paul Engelmayer, district judge for the Southern District of New York, issued an emergency ruling blocking DOGE from accessing Treasury Department data.
But Engelmayer’s ruling went even further than that.
It blocked Treasury Secretary Scott Bessent himself from accessing the data, which is asinine.
The New York Times reported that “Engelmayer, in an emergency ruling early Saturday morning, ordered such officials who had been granted access to the systems since Inauguration Day, Jan. 20, to ‘immediately destroy any and all copies of material downloaded from the Treasury Department’s records and systems.’ Judge Engelmayer said in the order that the officials’ access heightened the risk of leaks and of the systems becoming more vulnerable to hacking.”
The judge’s ruling was in response to a lawsuit filed by 19 attorneys general, including New York Attorney General Letitia James.
The Times continued, “The Trump administration’s filing on Sunday noted that the government and the attorneys general were negotiating to ‘at least narrow’ the issues in dispute. The administration’s filing called Judge Engelmayer’s order ‘markedly overbroad’ and said it wrongly constrained even Treasury Secretary Scott Bessent.”
The administrative state
According to the Left, unelected bureaucrats at the Treasury Department are not even accountable to the Treasury Secretary.
Trump’s attorneys wrote in a legal filing, “There is no sound reason that it should extend to Treasury’s leadership, who are charged with overseeing and administering the department without interruption. . .To the extent the order applies to senior political appointees at Treasury, it is an extraordinary and unprecedented judicial interference with a cabinet secretary’s ability to oversee the department he was constitutionally appointed to lead.”
In the mind of Permanent Washington, the administrative state is an autonomous fourth branch of government.
That’s why Democrats—and some establishment Republicans—accuse Trump of engaging in a “coup.”
Trump is the head of the Executive Branch, so he has authority over the departments under that branch.
However, unelected bureaucrats in the administrative state have come to believe that they are in charge regardless of who’s in the White House.
The Times added that Trump’s lawyers “argued that the order violated the Constitution by ignoring the separation of powers and severing the executive branch’s right to appoint its own employees. The restriction, they wrote, ‘draws an impermissible and anti-constitutional distinction’ between civil servants and political appointees working in the Treasury Department.”
Democrats don’t believe that Trump should have control of the Executive Branch even though he was elected to lead the Executive Branch.
