Things aren’t going well for Vice President Kamala Harris in the closing days of the race.
She’s watched former President Donald Trump overtake her in the RealClearPolitics polling average for all seven battleground states.
Democrats are fretting about the possibility of Trump returning to the White House.
The blame game is underway for Kamala’s struggles in the election.
X owner Elon Musk emerged as a villain for the Left when he endorsed Trump after the former President was shot at a campaign rally in Pennsylvania.
The billionaire entrepreneur appeared at Trump’s rally when he returned to Butler, Pennsylvania after his assassination attempt.
Musk poured $75 million into a super PAC backing Trump and has appeared in town halls in the crucial battleground state of Pennsylvania.
The Tesla founder announced that he was going to give away $1 million each day to voters in one of the battleground states who signed a petition his America Pac has to support free speech and the Second Amendment.
Democrats were already furious that he returned free speech to social media after he purchased X.
Now, Musk trying to move the needle to get Trump elected has their rage boiling over.
Law professor wants to end free speech over Elon Musk’s involvement in the election
University of California at Los Angeles law professor Rick Hasen floated the idea of eliminating free speech from the Constitution for “ultra-wealthy” individuals like Musk.
“To be clear, under current law, it’s unconstitutional, thanks to the Supreme Court, to limit spending in elections. Supreme Court decided that in 1976,” Hasen said. “They reaffirmed that in the Citizens United case in 2010.”
Hasen lamented the fact that limiting the free speech rights of Americans by blocking them from spending on elections was a no-go because of the Supreme Court.
“You know, Congress tried to pass laws eliminating spending by the ultra-rich in elections, and the Supreme Court said that that’s a violation of the First Amendment,” Hasen explained. “So, all the other things that Musk is doing, his work with X, his giving the money to the Super PAC, those are all considered legal under the current system.”
“And then the question is, you know, do we want to think about amending the Constitution to change the role of the ultra-wealthy?” Hasen asked.
Democrats have been pushing to control speech in elections with campaign finance reform by overturning the Citizens United decision that allowed Big Labor, corporations, and associations to spend money in elections.
They want to rig the system for their benefit to control what can be said during campaigns.
Hasen claimed that Musk’s $1 million raffle was a crime.
“But that’s really very different than what Musk is doing with this lottery, which seems to be a clear violation of federal law,” Hasen said.
Democrats have most of the billionaires in the country on their side.
Hasen is angry that Kamala is struggling and looking for someone to blame.
