Democrats still refuse to accept the fact that Donald Trump won the election fair and square.
They’re desperate to find a loophole to keep him from being President.
And now a Barack Obama operative just launched one final Hail Mary to keep Donald Trump out of the White House.
Democrats scheme to keep Donald Trump from becoming President
President-elect Donald Trump left no doubt when he swept all seven swing states and became the first Republican in 20 years to win the popular vote.
That didn’t stop some Democrats from trying to find a way to get Vice President Kamala Harris installed as President after the election.
High-powered Democrat attorney David Schulte – a close ally and donor to former President Barack Obama – and Democrat attorney Evan Davis concocted a scheme that they claim could stop Trump from becoming President.
They cited the insurrection clause in the 14th Amendment to disqualify Trump from the Presidency in an opinion piece for The Hill.
Colorado used the same tactic to throw Trump off the Republican Presidential Primary ballot in the state before the Supreme Court smacked them down earlier this year.
The insurrection clause states that no one can hold federal office if they’ve taken an oath to the Constitution and engaged in insurrection or given aid or comfort to the enemy.
“Disqualification is based on insurrection against the Constitution and not the government,” Schulte and Davis wrote. “The evidence of Donald Trump’s engaging in such insurrection is overwhelming. The matter has been decided in three separate forums, two of which were fully contested with the active participation of Trump’s counsel.”
They cited the second impeachment hoax against Trump over January 6 as grounds for disqualification under the insurrection clause.
Flimsy argument to disqualify Trump falls apart under scrutiny
Davis and Schulte also cited the Colorado Supreme Court’s ruling where the Democrat justices declared that Trump was guilty of insurrection without a trial.
Former Speaker of the House Nancy Pelosi’s (D-CA) January 6th Committee was also cited because it claimed that Trump engaged in an insurrection.
These examples supposedly give Congress the ability to use the Electoral Count Act to reject Trump.
“The act specifies two grounds for objection to an electoral vote: If the electors from a state were not lawfully certified or if the vote of one or more electors was not ‘regularly given.’ A vote for a candidate disqualified by the Constitution is plainly in accordance with the normal use of words ‘not regularly given,’” Schulte and Davis argued.
They claimed that using insurrection as a disqualification would be the same as using age as a justification.
20% of the House would have to vote for a petition to disqualify Trump’s Electoral Votes and it would have to be sustained by a majority vote.
“If all votes for Trump were not counted, Kamala Harris would be elected president,” Schulte and Davis concluded.
The Supreme Court shut down this fantasy in a unanimous ruling that Colorado couldn’t remove Trump from the ballot by declaring it null and void.
He would have to be convicted of insurrection which he was never charged with by any Democrat prosecutor.
These Democrats want to do exactly what they falsely accused Trump of doing by overturning the results of a free and fair election.
Some Democrats will never accept that Trump will be President and dream up fantasies to keep it from happening.
