Elon Musk and Donald Trump are on a crusade to eliminate waste, fraud, and abuse in the federal government.
Democrats aren’t giving up a dime without a fight.
But a federal prosecutor stopped one attack against Elon Musk and DOGE dead in its tracks.
Democrats attack DOGE as an illegal and illegitimate agency
President Donald Trump established the Department of Government Efficiency (DOGE) with an executive order on his first day in office and tapped Tesla CEO Elon Musk to lead it.
The United States Digital Service created under former President Barack Obama was repurposed as DOGE.
Democrats and left-wing activist groups have attacked the legitimacy of DOGE after the group uncovered corrupt spending at the United States Agency for International Development (USAID).
Musk and his work have been attacked as illegal and illegitimate by government employee unions and Democrats in lawsuits against DOGE.
Former federal prosecutor Andy McCarthy shut down these attacks against DOGE during an appearance on Fox & Friends.
“The litigation is kind of designed to slow things down and they have vast resources to conduct this kind of litigation,” McCarthy explained. “You have sort of these cabals of state attorneys general, you have all kinds of well-heeled left-wing groups that can do this.”
McCarthy predicted that these attempts to discredit DOGE would fail once a judge handed down a ruling.
“But ultimately, I think, if you get clear rulings from the court, a lot of this stuff will fade away,” McCarthy said.
“It seems to me the weakest position that they have is that executive branch officials, and whether they like it or not, they keep calling it the so-called DOGE, as if it didn’t exist, it actually is a component of the executive office of the president in the White House, it’s a refinement of something that was begun under Obama,” McCarthy added.
Democrats are using a kooky legal theory against Trump and DOGE
The Trump administration has been hit with an avalanche of lawsuits from Democrat state attorneys general and government employee unions that essentially argue he can’t be President.
They get Democrat judges to restrict the power that Trump has over the executive branch and carry out the duties of being President.
Essential powers of the Presidency like being able to take down a government website or audit federal agencies are being stripped away from Trump by activist judges.
McCarthy called the legal arguments being used against Trump and DOGE “nutty.”
“So, this is a legitimate government entity, and they answer to the president, who runs the executive branch,” McCarthy stated. “So the idea that an executive official answerable to the president, can’t look at what’s going on in executive agencies is pretty nutty and I think that should fade away fast.”
The former federal prosecutor warned that cases that argued DOGE took away power from Congress could take a while to make their way through the legal system.
“I think what we are seeing is a lot of forum shopping and there is a lot of opportunity for these lower court judges to slow walk-stuff,” McCarthy explained. “And then the thing you have to worry about up in the Supreme Court is that you have some judges who just don’t like the emergency docket and they like the idea, even if there are justices who you think would be inclined to rule the president’s way, they like things to come in regular order, rather than expedited.”
Democrats are going to try and tie down DOGE with frivolous court cases.
