Activist Judges block gang members from being deported
Violent gangs of illegal aliens like Venezuela’s Tren de Aragua and El Salvador’s MS-13 thrived under former President Joe Biden’s open border.
President Donald Trump designated these and other illegal alien gangs as foreign terrorist organizations.
He invoked the Alien Enemies Act of 1798 to expedite the deportations of these gang members without an immigration court hearing as national security threats.
D.C. District Court Judge James Boasberg, who was appointed by former President Barack Obama, issued a temporary injunction blocking Trump from using the law.
Boasberg let former FBI lawyer Kevin Clinesmith off with a slap on the wrist after he forged an email to get a FISA warrant to spy on the 2016 Trump campaign during the Russian collusion hoax.
A D.C. Appeals Court upheld Boasberg’s decision after the Trump administration appealed.
George Washington University law professor Jonathan Turley, who served as Trump’s attorney during the first impeachment hoax, said the President is “likely to win” his legal case against activist Judges over his use of the Alien Enemies Act during an appearance on Fox News.
“I think there’s a legitimate complaint here. It’s like having a car where every passenger is pressing the emergency break,” Turley said. “It’s pretty hard to drive that car. And what you have here are Judges that are imposing national injunctions which the Supreme Court, including liberal justices like Justice [Elena] Kagan have objected to. She said ‘This is madness’ that you have all of these trial Judges who are imposing national injunctions.”
Judicial overreach will backfire on lower court Judges
District Court Judges have seized constitutional powers from Trump with overreaching decisions.
Judges have given themselves the supreme authority to make decisions like who the President can fire from the government and set the fitness standards for the military.
Turley predicted that Trump would prevail in these cases.
“I also think the Trump administration is likely to prevail in most of these cases. I think that federal Judges have overextended themselves, they have intruded into areas of Article II, which is Presidential authority,” Turley explained.
Boasberg seized control over national security and foreign affairs policy when he blocked the use of the Alien Enemies Act and ordered planes carrying more than 200 Tren de Aragua members to a terrorist prison in El Salvador to turn around in mid-flight and return to the United States.
White House Press Secretary Karoline Leavitt said the administration ignored the ruling and delivered the gang members to El Salvador because the flight was outside of American airspace.
The Trump administration faced 15 temporary restraining orders in February which was more than former President Joe Biden faced during his first three years in office.
