The Trump administration asks the Supreme Court to smack down Democrat Judges
President Donald Trump has faced an onslaught of lawsuits against his administration’s actions from Democrat attorneys general and left-wing activists.
They filed their lawsuits against the administration in jurisdictions where they knew they could get an activist Democrat Judge to rule in their favor.
Democrat Judges refuse to let Trump be President with overreaching decisions that strip away basic constitutional powers of the office.
Treasury Secretary Scott Bessent was blocked from accessing data in his own department because of a court order against the Department of Government Efficiency (DOGE) by a Democrat Judge.
An application with the Supreme Court by the Trump administration in the case involving the executive order banning birthright citizenship asked the Justices to stop these rogue Judges.
The application argued that Judges don’t have the power to govern the country by issuing universal injunctions and temporary restraining orders [TROs] that stop Trump’s policies from going into effect while the legal process plays out.
“District courts have issued more universal injunctions and TROs during February 2025 alone than through the first three years of the Biden Administration,” the application stated. “That sharp rise in universal injunctions stops the Executive Branch from performing its constitutional functions before any courts fully examine the merits of those actions, and threatens to swamp this Court’s emergency docket.”
The Trump administration asked the Supreme Court to restrict the use of universal injunctions that “compromises the Executive Branch’s ability to carry out its functions, as administrations of both parties have explained.”
Democrat Judges want to keep Trump from being President
The application didn’t ask the court to weigh in on the constitutionality of banning birthright citizenship.
“At this stage, the government comes to this Court with a ‘modest’ request: while the parties litigate weighty merits questions, the Court should ‘restrict the scope’ of multiple preliminary injunctions that ‘purpor[t] to cover every person * * * in the country,’ limiting those injunctions to parties actually within the courts’ power,” the application argued.
Trump could find support from some of the Justices.
Supreme Court Justice Samuel Alito slammed a ruling by the high court that upheld a lower court decision to force the Trump administration to pay almost $2 billion in foreign aid payments.
“Does a single district-court Judge who likely lacks jurisdiction have the unchecked power to compel the Government of the United States to pay out (and probably lose forever) 2 billion taxpayer dollars? The answer to that question should be an emphatic ‘No,’ but a majority of this Court apparently thinks otherwise,” Alito wrote in his dissent. “I am stunned.”
Justices Clarence Thomas, Neil Gorsuch, and Brett Kavanaugh joined Alito in the dissent.
